Terms of Service

By accessing, installing, or using the DeathCam.gg service ("the Service"), including the Discord bot, game server resource, and any associated APIs or websites, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must immediately cease all use of the Service. These Terms apply to all users of the Service, including server owners, community administrators, and end users. Your continued use of the Service constitutes ongoing acceptance of these Terms as they may be updated from time to time.

DeathCam.gg is a video capture and retrieval service designed for online multiplayer game server communities. The Service automatically records short video clips upon certain in-game events and stores those clips for a limited retention period. Authorised users may retrieve clips via a Discord bot using a unique clip code.

DeathCam.gg does not control, moderate, or take responsibility for how communities use the footage retrieved through the Service. Any action taken based on retrieved footage is entirely the responsibility of the community or individual acting upon it.

You must be at least 13 years of age to use this Service, in compliance with Discord's Terms of Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you must have the consent of a parent or legal guardian. DeathCam.gg reserves the right to terminate access for any user who does not meet these requirements.

Server owners who integrate DeathCam.gg into their community are issued an API key upon adding the DeathCam bot to their Discord server. You agree to:

• Keep your API key confidential and not share it with unauthorised parties
• Take full responsibility for all usage and activity that occurs under your API key
• Notify DeathCam.gg immediately if you believe your API key has been compromised

DeathCam.gg reserves the right to revoke, suspend, or rotate API keys at any time, with or without notice, for any reason including but not limited to suspected abuse or violation of these Terms.

You agree not to use the Service to:

• Capture, store, or distribute footage in violation of any applicable laws or regulations
• Harass, defame, threaten, or harm other players or individuals
• Attempt to reverse engineer, decompile, exploit, tamper with, or circumvent any aspect of the Service
• Use the Service on servers or communities that have not consented to its installation and operation
• Overload, disrupt, or degrade the performance of the Service or its infrastructure
• Use the Service for any unlawful, fraudulent, or malicious purpose

DeathCam.gg reserves the right to suspend or permanently ban any user or community found to be in violation of this section, without notice and without refund.

ALL PURCHASES AND SUBSCRIPTION PAYMENTS ARE FINAL AND NON-REFUNDABLE.

By completing a purchase or subscribing to a paid tier of the Service, you acknowledge and agree that:

• No refunds will be issued under any circumstances, including but not limited to change of mind, dissatisfaction with the Service, or failure to use the Service during a billing period
• Cancellation of a subscription will take effect at the end of the current billing period — no partial refunds will be issued for unused time
• Accounts suspended or terminated due to violation of these Terms are not entitled to any refund of fees paid
• DeathCam.gg is not responsible for any charges incurred as a result of continued subscription billing prior to cancellation

If you have a billing dispute you believe to be in error, you must contact us within 7 days of the charge via our Discord support server. We reserve the right to make exceptions at our sole discretion, but are under no obligation to do so.

DeathCam.gg does not guarantee uninterrupted or error-free operation of the Service. We reserve the right to perform maintenance, updates, or modifications to the Service at any time without notice. We shall not be liable for any loss or damage resulting from downtime, interruption, or unavailability of the Service.

Clip capture is dependent on the client-side resource operating correctly on each user's machine. DeathCam.gg does not guarantee that every in-game event will result in a successfully captured and uploaded clip. No compensation or refund will be provided for missed or failed captures.

Video clips are stored on third-party cloud infrastructure and are subject to automatic deletion after a defined retention period. DeathCam.gg does not guarantee the availability of any clip beyond this period and shall not be held liable for the loss of any footage. We reserve the right to adjust retention periods at any time.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

DeathCam.gg expressly disclaims all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free, or that any footage will be captured, stored, or retrievable.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEATHCAM.GG AND ITS DEVELOPERS, OFFICERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND.

This includes but is not limited to:

• Loss of data, footage, or evidence
• Loss of revenue, profits, or business opportunity
• Damage to reputation or relationships
• Any decisions made by communities or individuals based on footage retrieved through the Service
• Any actions taken by third parties in relation to footage captured or distributed via the Service

DeathCam.gg's total cumulative liability to you for any claims arising out of or related to the Service shall not exceed the total amount paid by you to DeathCam.gg in the three (3) months preceding the claim.

You agree to indemnify, defend, and hold harmless DeathCam.gg and its developers, officers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any footage captured, stored, retrieved, or distributed through your use of the Service
• Any decisions or actions taken based on footage retrieved through the Service

The Service relies on third-party platforms including but not limited to Cloudflare, MongoDB, and Discord. DeathCam.gg is not responsible for the availability, performance, or policies of these third-party services. Use of these platforms is subject to their respective terms of service and privacy policies.

All software, branding, documentation, and associated materials related to DeathCam.gg are the intellectual property of DeathCam.gg and its developers. You may not reproduce, modify, distribute, or create derivative works from any part of the Service without explicit written permission.

DeathCam.gg reserves the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, and without liability to you. Upon termination, all rights granted to you under these Terms will immediately cease. No refund will be issued upon termination for violation of these Terms.

DeathCam.gg reserves the right to update or modify these Terms at any time at its sole discretion. We will endeavour to notify users of material changes via the DeathCam.gg Discord server. Your continued use of the Service following any posted changes constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia. You waive any objection to the exercise of jurisdiction over you by such courts.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and DeathCam.gg with respect to the Service and supersede all prior agreements, representations, and understandings of any kind.
